The following terms and conditions apply to all bookings made with us over the phone, by email or online through our website.

References to "us", "we" and/or "our" in these booking terms and conditions means PUK Tours Limited and PUK Tours.

References to “you”, “your”, “the customer” in these boking terms and conditions means the person or group of people who make a booking with Puk Tours.

These terms and conditions also apply to bookings you make using the services of an agent.

Reservations

Your booking is considered to be confirmed and accepted in respect of all persons travelling when we issue a confirmation to you or your agent.

If you book through an agent, we will address all on-going correspondence to that agent. All monies paid by you to the agent will be held on behalf of PUK Tours Limited.

If you book direct with PUK Tours Limited, all correspondence will be sent to the address of the first person on the booking file unless you tell us otherwise.

Typically a booking will take 3-5 days to be processed, depending on the complexity of the arrangements required.

Unless otherwise specified, PUK Tours will send you a Confirmed Itinerary within 5 working days of receipt of full payment.

Any discrepancy between the Confirmed Itinerary and your intended booking must be made known by you or your agent to PUK Tours within 5 working days of your receipt of the Confirmed Itinerary or before the commencement of travel, whichever is the earliest.

Deposits and Payments

All prices expressed on PUK Tours’ website are in New Zealand dollars NZ$ and exclude GST.

A non-refundable deposit of NZ$300 per person or 10% of the value of the package price (whichever is greater) must be received by us within 2 days of your booking in order for us to confirm and hold a place for you on your chosen tour. Any additional deposits required by our suppliers will also be collected at this time. Balance of payment of the price of the package is due 30 days prior to your travel date.

Failure to pay the deposit or full payment will result in the cancellations of your booking.

Payment by you of the deposit is deemed to be confirmation from you that you have read, understood and accepted our terms and conditions.

Method of Payment and Credit Cards

We are pleased to accept electronic wire transfers (direct credits to PUK Tours Limited’s bank account) as well as PayPal, Visa and Mastercard.

Variations to Bookings

An administration fee of 10% of total package price will be charged to cover our costs for making variations to your bookings. We may also need to pass on any amendment/cancellation fees imposed by our suppliers.

Booking Cancellations

If, after we have accepted and confirmed your booking, you wish to cancel, the following cancellation fees will apply:

  • For cancellations 31 or more days prior to travel: Your deposit plus a further 10% of the total package price.

  • For cancellations 15 – 30 days prior to travel: Deposit + a further 20% of the total package price.

  • For cancellations 0-14 days prior to travel: 100% of total fare (no refund) Any cancellation fees imposed by suppliers will also be charged.

    A cancellation can only be accepted in writing either from the person who made the booking or the agent through whom the booking was made. The cancellation will be effective from the date on which it is received by us.

    We recommend you purchase travel insurance to cover unforeseen circumstances

    Refunds

    Any unused or partially-used sections of the travel arrangements are non-refundable.

    You may be able to claim a refund of your cancellation charges from your insurer, if your cancellation complies with the terms of your particular insurance cover.

    Cancellations or Changes by PUK Tours Limited

    After your tour commences it is unlikely that we will need to make any changes but sometimes it is inevitable, particularly if your safety is at risk. PUK Tours Limited reserves the right to alter fares, amend itineraries or to cancel arrangements. Assistance will be provided to make alternative arrangements to a similar value when and where practical.

    Refunds are not available where circumstances arise beyond the control of the PUK Tours Limited necessitating alternative arrangements to be made to ensure the safety and /or further participation and enjoyment of your holiday.

    Force Majeure

    Compensation will not be payable if we need to cancel or change your travel arrangements in any way for reasons including but not limited to war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or other circumstances amounting to force majeure.

Special Requests and Needs

Please also advise us in writing at the time of booking of any special needs and/or requests you or a member of your group may have. We will endeavour to meet special requests, but cannot guarantee that they will be able to be accommodated. Nor will we be responsible if any are not met.

Children

Our tours unsuitable for children.

Website Validity and Accuracy

The packages and prices contained within this website are valid at the time of publication. We reserve the right to adjust these as necessary. The appropriate fare will be confirmed to you at the time of confirmation. If it is different to what you had expected then you do not have to proceed with the booking. Once you have paid for your travel arrangements in full we will hold the price.

The inclusions in each fare are clearly stated in the website. All other expenses including but not limited to food, beverages, refreshments, laundry, visa/passport fees, telephone and communication costs, taxi fares, excess luggage charges and items of a personal nature are not included.

Although the information in our website has been compiled with diligence and care and every effort has been made to ensure its accuracy, unfortunately errors can sometimes occur. Please check all details at time of booking with us.

Liability

Responsibility: You acknowledge and agree that PUK Tours Limited accepts no responsibility and will not be liable to you or any third party for any loss, cost or damage (including loss of enjoyment) suffered directly or indirectly in connection with:

  1. (a)  any risks or other aspects of any tour provided by us;

  2. (b)  any change to your itinerary or delays in departure or arrival times of aircraft or otherwise during the conduct of any tour or other travel arrangement;

  3. (c)  any loss or damage to your baggage;

  4. (d)  any personal injury or death resulting from the acts or omissions or negligence of any third parties providing goods or services to you during your tour or other travel arrangements including, without limitation, air carriers, hotels, restaurateurs, transportation providers and/or medical personnel; or

  5. (e)  any loss of enjoyment by you due to circumstances outlined in these terms or otherwise beyond PUK Tours Limited control.

Total liability: Notwithstanding any other provision of these Terms, and to the maximum extent permitted by law, PUK Tours Limited’s maximum liability to you or any third party (including any claims of negligence on the part of PUK Tours Limited) is limited to the amounts actually paid by you with respect to your booking (excluding insurance premiums, variation fees and other third party fees or costs (as applicable).

Consequential loss: PUK Tours Limited will not be liable for any loss of enjoyment, opportunity, profit, savings, revenue or interest or any other consequential or indirect, incidental, special or

punitive loss, damage or expenses even if PUK Tours Limited has been advised of their possible existence and even if such loss, damage or expense is caused by PUK Tours Limited negligence.

Indemnity: You agree to indemnify PUK Tours Limited for any loss or damage suffered by PUK Tours Limited as a result of, or in connection with, any breach of these terms or any negligence or willful default, by you (or any other person covered by your booking).

Warranties

Unless otherwise specified, where the Consumer Guarantees Act 1993 applies the customer shall have all the rights and remedies provided under this Act but no others.

Service and Assistance

If an unexpected problem occurs during your travel arrangements then, in your own best interests, please contact our office without delay. Only by doing this can we take steps to remedy the situation and to help you.

Travel Insurance

We strongly recommend that you arrange comprehensive travel insurance at the time you book your tour with us.

Health

It is your responsibility to ensure that you are aware of any health requirements for your travel destinations and to ensure that you carry all necessary vaccination documentation.

Please advise us in writing at the time of booking if you have any medical conditions or disabilities which may affect your travel arrangements. If we cannot accommodate your needs/requirements, we will advise you at that time.

Travel Documents

It is your responsibility to ensure that all necessary travel documents (eg passports, visas) are valid and effective.

PUK Tours shall not be liable to you should you be disallowed, denied or refused participation in the activities, accommodation or travel booked by us due to your lack of valid travel documentation, certification or actions whilst travelling.

Privacy

The Customer agrees that:

  1. (a)  the personal information provided, obtained and retained by PUK Tours Limited about the customer will be held and used for the purposes directly related to the provision of services to the customer under these terms and conditions;

  2. (b)  acceptance of these terms and conditions is the customer’s irrevocable authority to PUK Tours Limited to use the personal information for the purposes set out herein and to provide any personal information (along with the details of any booking between PUK Tours Limited and the customer) to any relevant third party and to obtain any information concerning the customer from any other source;

(c) the Customer must notify PUK Tours Limited of any changes in circumstances that may affect the accuracy of the information provided by the customer to PUK Tours Limited. If the customer is a natural person the customer has the right of access to and correction of any personal information held by PUK Tours Limited;

(d) the customer acknowledges and gives consent for PUK Tours LImited by itself or through an agent to take photographs, audio or video recordings, or other forms of recordings that capture the passenger’s image, likeness, voice, performance or all of these (“Images”) during the course of a tour. The passenger acknowledges and gives consent for PUK Tours Limited to receive and use Images of the passenger for marketing and promotional purposes.

Assignment

You shall not assign all or any rights or obligations under these terms and conditions of trade without the written consent of PUK Tours Limited.

PUK Tours Limited is entitled to assign or subcontract to any other party all or any part of the work which is to be performed by us under any contract.

In respect of the rights and obligations created by these terms and conditions, an assignee shall be entitled to the full rights of PUK Tours Limited.

Disputes

If you are dissatisfied any complaint must be made in writing to us within 30 days of the issue which gives rise to the complaint. Please include your booking reference – this will help us to respond to you quickly.

In the event were are unable to resolve your complaint and you wish to dispute any matter arising between PUK Tours Limited and you, such dispute shall in the first instance be referred to mediation for resolution.

In the event that resolution by mediation is not achieved to the satisfaction of both parties within 30 days of referral to mediation, either party may then take legal action to resolve the dispute.

Nothing in this clause prevents PUK Tours Limited from taking legal action to enforce payment of any debt due, nor where required to seek interlocutory or injunctive relief.

Notices

All notices required or committed under these Terms of Trade are to be served in writing either by post, facsimile or email.

Validity

If any provision of this contract shall be invalid, void or illegal or unenforceable the validity existence, legality and enforceability of the remaining provisions shall not be affected, prejudiced or impaired.

Changes of General Terms and Conditions

PUK Tours Limited may at any time refuse a booking by you for any lawful reason whatsoever.

Terms and conditions are subject to change without prior notice

Failure by PUK Tours Limited to enforce any of the terms and conditions contained in these Terms and Conditions of trade shall not be deemed to be a waiver of any of the rights or obligations PUK Tours Limited has under these Terms and Conditions of trade.

Law and Jurisdiction

Any matters arising in relation to the contract between us will be governed by New Zealand law and subject to the jurisdiction of the Courts of New Zealand.

Entire Agreement

These Terms and Conditions of Trade constitute the entire agreement and supersede and extinguish all prior agreements and understandings between PUK Tours Limited and the customer.
